by the Board of Directors of OCEAN TOWERS OF HUTCHINSO ISLAND
CONDOMINIUM ASSOCIATION, INC., a Florida corporation, hereinafter
referred to as the "Association,"
W I T N E S S E T H:
WHEREAS, OCEAN TOWERS CONDOMINIUM B, Hutchinson Island,
St. Lucie County, Florida, hereinafter referred to as the "Condo-
minium," has been developed by OCEAN TOWERS DEVELOPMENT CORPORATION,
a Florida corporation, hereinafter referred to as the "Developer,"
and a Declaration of Condominium and Exhibits thereto were recorded
for the Condominium on February 17, 1981, in Official Records Book
348, Pages 2288 through 2348, inclusive, of the public records of
St. Lucie County, Florida, and
WHEREAS, said Declaration of Condominium contains factual
inaccuracies which have been generated by minor changes in circum-
stances, none of said changes being substantial in nature or extent,
and
WHEREAS, at a meeting duly called for such purpose, the
Board of Directors of the Association has voted unanimously in favor
of amending the above-said Declaration of Condominiur.~ pursuant to
Section 16.2(c) thereof, as set forth hereinbelow.
NOW THEREFORE, be it resolved by the Board of Directors
of t~e Association that the Declaration of Condominium of OCEAN
TOWERS CONDOMINIUM B, recorded as set forth above, be and is hereby
amended as follocvs :
1. Section 5.ltd) of the Declaration is deleted and in
lieL and substitution therefor the following section is hereby
estab~~shed:
5.1(d) Water and Sewer service shall be furnished by
Ocean Towers Utilities Corporation, Inc., a Florida non-profit corpo-
ration, which shall also supply water and sewer service to the owners
of the property as described in Exhibit "A-15" to this Declaration,
and other properties owned or developed by the Developer, its parent
corporation, or subsidiaries thereof. The members of Ocean Towers
Utilities Corporation, Inc. shall be all condominium, home owners
or property owners' associations served by the utility, said member-
ship being mandatory. Each apartment shall share equally in the
cost of water and sewer service to its respective building. These
costs shall be considered a part of the common expenses of the Condo-
minium and therefore a part of the quarterly assessment made for
common expenses. See Exhibit "A-14" to this Declaration for reference.
2. The name of the Association as set forth in the Condo-
minium's documents is Towers Condominium Association, Inc. The actual
name of the Association as accepted and filed by the Secretary of
State, State of Florida, is OCEAN TOWERS OF HUTCHINSON ISLAND CONDO-
MINILIM ASSOCIATION, INC. Therefore, the name of the Association is
hereby amended accordingly throughout the above-said Declaration of
Condominium. See Exhibit "A."
