ORDER GRANTING PETITIONER'S MOTION
FOR RELIEF FROM ORDER OF TAKING
AND AMENDING ~ORDER OF TAKING
• THIS CAUSE came on before the Court, after notice,
upon the Motion for Reconsideration and Alternatively for
Relief from Order Denying Taking on the Ground of Mistake
of the petitioner, Florida Power & Light Company. This
Court has considered the motion, the testimony and evi-
dence offered by the parties, the~argument of counsel and
is otherwise Fully advised. Upon consideration, it is
therefore
ORDERED AND ADJUDGED:
1. That Florida'Power s Light Company has offered
sufficient testimony and evidence to establish a reasonable
necessity for the taking of parc.els 1D and lE in this cause
as a matter of law.
2. That this Court has jurisdiction to amend the
Order of Taking entered in this cause on December 10,
1980, on the ground of mistake pursuant to Rule 1.540(b),
Florida Rules of Civil Procecure, insofar as it pertains
to Parcels 1D and lE.
3. That the ~leadings in this cause are sufficient
and that the estimate of value filed by the petitioner is
made in good .faith and based upon a valid apvraisal.
