HomeMy WebLinkAbout01473. Defendant's Motion for Leave to File a Counter-claim for
abuse of process is hereby granted and its ore tenus motion to add
additional affirmative defenses is also granted. The Defendant
shall have days from the date of service of the Plaintiff's
amendments to the Amended Complaint as described above within which
to serve said counter~claim and whatever additional affirmative de-
fenses it desires.
4. Defendant's Motion for Simmaary Judgment is denied for the
present, pending resolution of all amendments to the pleadings and
pending receipt from the Plaintiff of. a Memorandum of Law as to what
material facts are in issue which would defeat the Defendant's Motion
for Sum~ary Judgment. Said Memorandum of Law shall be served within
thirty (30) days from the date of this Order~ with the Defendant hav-
ing twenty (20) days after service of same within which to serve a
Memorandwn of Law in answer thereto.
