ORDER ON DEFENDANTS' MOTIONS TO COMPEL,
TO STRIKE PUNITIVE DAMAGES ANB ATTORNEYS'
FEES, AND TO DI SI~tI SS THE SECOND AMENDED
COMPLAINT
THIS CAUSE came on to be heard upon Defendants' Motions to
Compel, to Strike Punitive Damages and Attorneys' Fees and to
Dismiss the Second Amended Complaint and the court being fully
advised in the premises, it is
ORDERED as follows:
1. The htotion to Compel is granted and Plaintiff is ordered
to respond further within twenty (20) days. All documents on which
Plaintiff claims the attorney-client or work-Product privilege,
with the exception of lette rs between officers of Plaintiff and
Plaintiff's counsel, shall be produced to this Caurt for an "in-
camera" inspection and furt~her hearing if deemed necessary by this
Court. The documents produced for the "in-camera" inspection shall
be briefly described to counsel for Defendants and kept in a sealed
en~relope in the Court file.
2. The Motion to Strike Punitive Damages and Attorneys' Fees is
granted and Plaintiff is given twenty (20) days to further amend to
state the statutory or contractual basis for attorneys' fees, and to
allege~a willful, independent tort which will support punitive
damages. Plaintiff is instructed to specifically state in each
