3. The Motion to Dismiss the Second Amended Complaint is
denied with the following exceptions. Plaintiff shall amend its
allegations to allege subclasses for all individual damages sought
to be obtained for interior damage or damage which is not to the
common elements. Plaintiff shall amend to reallege Count I as
general allegations. Plaintiff shall amend to reallege Count II
so that the separate actions for breach of warranties are not
intermingled. Plaintiff shall have twenty (20) days to amend and
Defendants ha~-e twenty (20) days from such amendment to answer.
Count IV which alleges strict liability in tort is hereby
dismissed with prejudice, for the reason that strict liability
in tort does not apply to an action alleging defective construction
