F. Common Ex enses means all exvenses and assessments
property incurre~y t~ Association for the Condominium and
includes~ but is not limited to: the expenses of administration
and maintenance~ operation, repair and rep lacement of the
common elements and of the portions of un3ts to be mainta~ned
by the Association; taxes, snecial assessments and insurance
for the comanon elements ; other expenses decl ared to be corrm-on
expenses herein and in the Bv-Laws; and anv other valid char~e
against the Condominium as a~whole.
~. Common S~urp lus means the excess of all receipts of. the
Association, inc ~ud-ing i~ut not limited to, assessments, rents,
profits and revenues on account of the common elements, over
the amount of co~non expenses,
H. Condominium means all of Che condominium property as a
whole when tne context so permits, as well as that form of
ownership of real propert}~ which is comprised of uni.ts that
may be owned by one or more persons, and in which there is
appurCenant to each unit an undivided share in the common elements.
I. Condominium Act means Chapter 718, Florida Statutes,
in existence as ot the ~ate of this Declaration.
J. Condominium Parcel means a unit, together caith the
undivided share in the common elements which is apnurtenant to
the unit.
K. Condominium Property means and i.ncludes the lanc~ herehv
submitted thereon, and the common elements; and all easements
and rights appurtenant thereto.
L. Declaration or Declaration of Condominium means this
instrument as it may trom time to time be amended.
t4. Developer means Bartlett M. Hackley, Sr., Individually
and as Trustee, and Bartlett M. Hackley and Annette Landau, as
Tr»StPeS f~r Rart Hacklev Accountancv Cornoration Emplovee's
Pension Trust, and whoever offers for sale condominium narcels
created herein in the ordinary course of business_
N. Institutional Mortgagee means a ban~:, bank holdin~ com~anv,
or subsidiary thereot, savings and loan association, insurance
company, union pension fund, mort~age company approved bv Developer,
its successor, grantees or assigns, agency of the llnited~States
Government~ or Developer~ its grantees, successors and assigns
holding a first mortgage of public record on a condominium
parcel or on any portion ~f the condominium propertv.
O. Land means the real property in St. Lucie Count~, Florida,
which is being submitted to condominium ownership.
P. Limited Common Elements means those common elements which
are reserved for the use ot a certain unit to the exclusion of other
units, and for all purposes herein shall be treated as common el.ements
as to the unit for which they are reserved.
Q. Occupant means the person or persons, other than the
unit owner, in possession of a unit or limited cornmon elements.
R. Special Assessment means a share of the funds required `or
payment ot common expenses which are unbudgeted or for which
insufficient provision is made in the budg,et, occasioned h~~
unforeseeable and fortuitous events, which from time to time
may be assessed against the unit owners.
S. Unit or Condominium ilnit means a part of the condominium
property which is subject to private ownership, to be used as
a single family residence and as designated on the exhibits attached
to this Declaration.
T. Unit Owner means the owner of a condominium unit.
