Condominium Unit shall be valid without the approval of the
Condominium Association except in the cases elsewhere provided
in this Declaration. which approval shall not be unreasonably
withheld. Approval shall be in recordable form, signed by
an executive officer of the Association and shall be delivered
to the purchaser or lessee and made a part of the document
of conveyance,
(4) Failure of the Association to act in thirty~
(30) days after receipt of written notice as provided for in
this Article XVII shall be deemed to constitute apuroval in
which event the Association must on demand prepare and
deliver approval in recordable form.
(5) No Unit Owner shall sell or lease a Unit, nor
shall approval for such be given until and unless all assessments
past and due are paid or ~heir payment provided for to the
satisfaction of the Association and unless the proposed
lessee can qualify as to the use restrictions.
(6) If a Unit OwnEr shall~lease his unit~ he shall
remain liable for the performance of all agreements and
covenants in the Condominium Documents and shall be liable
for the violations by his lessee of. am~ and all use restrictions.
(7) Every purchaser or lessee who acquires any
interest in a Condominium Unit shall acquire the same subject
to this Declaration, the provisions of the Bylaws of the
Condominium Associarion and the provisions of The Condominium
Act.
(H) Should any Condominium Unit at any time become
subject to a mortgage or simi~ar lien given as security, in
good faith and for value, the holder thereof (hereinafter
called the "Mortgagee"), upon becoming the (lwner of such
interest through foreclosure of that mortgage or deed in
lieu of foreclosure, shall have the unqualified right to
sell~ lease or otherwise dispose of said unit, including the
fee ownershin thereof, without compiying with the provisions
of Paragraphs 1 through 5 above, provided however, that in
all other respects the provisions of this Declaration, the
Bylaws of the Association and the provisions o.f 'I'he Condominium
Act shall be applicable thereto; and provided further that
nothing herein contained shall be deemed to allow or cause a
severance from the condominium unit of the share ~f the
Common Elements and Limited Common Flements or other apnurtenances
of said unit. Once the '~ortgagee mentioned above has sold,
transferred or conveyed his fee simple interest ~o any '
person whomsoever, the provisions of Paragraphs 1 through S
above shall again be fully effective with regard to subsequent
sales or conveyances of said unit.
B. Heirs And Devisees (lf neceased t?nit Owners.
(1) If the owner of a condominium parcel should
die and the title to the parcel shall pass to his surviving
spouse or to any member of his familv regularly in residence
with him in the condominium parcel prior to his death, then
such successor in title shall fully succeed to the ownershin,
rights, duties and obligations of the unit owner, the provisions
of this Article notwithstanding. •
(2) If the title to the condominium parcel of such
deceased owner shall pass to any person other than a person
or persons designated in Paragraph B-1 above, then within
ninety (90) days of such person or persons' taking title,
