THIS INDENTURE, made this 3rd day of Februarv . 1981, between
HIGH POINT EQUITIES, INC. , a Florida corporation, hereinafter referred to

WIT~NESSETH: •-
That Grantor, for and in consideration of the sum of TEN (tIU.00)
DOLLARS and other good and valuable consideration paid by Grantee, the
receipt of which is hereby acknowledged, has granted, bargained, and sold to
Grantee and Grantee's heirs and assigns forever the following described real
property situated, lyinq and being in St. Lucie County, Florida, to wit:
The Condominium Parcel known as Apartrnent 1210 -Aof
Phase `~v of HIGH POINT OF FORT PIERCE CONDOMINILIM
SECTION II (the "Condominium") according to the Declara-

Book 30~ at Pages 1396 through 1508 of the Public
Records of St. Lucie County, Florida as such Declaration
may have been amended by any amendments thereto
hereto filed in the Public Records of St . Lucie County ,
Florida including, but not limited to, any amendment to
add the aforesaid Phase to the Condominium (if such
Phase be other than Phase I thereof).
Grantee ,. by acceptance hereof , and by agreement with Grantor hereby
expressly assumes and agrees to be bound by and to comply - with all of the
covenants, terms, conditions and provisions set forth and contained in the
aforedescribed Declaration of Condominium, including, but not limited to, the
obligation to make payment of assessments for the maintenance and operation
of the Condominium which may be levied against the above described Apart-
ment. Grantee expressly acknpwledges the existence of a Settlement Stipula-
tion and Agreement for and Grant of Easements and Other Rights (the "Settle-
ment Stipulation") and a Declaration of Protective Covenants and Restrictions
(the "Protective Covenants") , as hereinafter set_ forth . The Settlement Stipu-
lation provides for this Condominiwn to be served by certain facillties of High
Point of Fort Pierce Condominium Section 1 and the Protective Covenants
provides for certain land use covenants upon the land areas described therein
(including, but not liinited to, porttons of the land areas included within this
Condominium) and provides for certain drai~age easements and other ease-
ments and rights including, but not limited to, the "Roadway Easement",
"Sewage System Riqhts" ,"Water System Rights" and "Future Development'
Property Drafnage Easement" , all as are more particularly described therein ,
all in addition to the other matters set forth in the Settlement ,Stipulation and
Protective Covenants, which other matters include, but are not limited to, the
obligation to pay certain "Assessments" as are respectively set forth in the
Settlement Stipulation and Protective Covenants . Grantee expressly acknowl-
edges and assumes the obligation Lo pay the amounts assessed against the
AparUnent under both the Settlement Stipulation and Protective Covenants and
acknowledges that "Assessments" under both the Settlement Stipulation and
Protective Covenants against all properties now or hereafter inciuded within
