(a) For that portion of t Land lying partially in
tracts A, II, C and D, CO~JiJting of ~.0~ res, more or less, as
shown on the Release Plat, the sum o~ $2 2,000.00. ~
(b) For portions of the Land located within Tract
A, releases shall be made at the rate of $65,500.00 per acre,
or fraction thereof.
(c) For portions of the Land located within Tract
8~ releases shall be made at the rate of $63,300.00 per acre,
or fraction thereof.
(d) For portions of the Land located within Tracts
C and D, releases shall be ma~e at the rate of $54,200.00 per
acre, or fraction thereof.
(3) Mortgagor's right to receive, and Mortgagee's obli-
gation to grant, releases of all or any portion of the Land fro~
this Mortgage shall be subject to the following restrictions:
(a) No portion of the Land designated to be
released shall be released if the re~ease would leave any por-
tion of- the Land remaining subject to this Mortgage without
access to Pruitt Road by means of either a fully developed
private paved road or a fully developed public road dedicated
to and accepted by the City of Port St. Lucie, Florida, in
ei~her of which events such road shall be contiguous to and
abut the unreleased portions of the Land, such road sha1Z be
reasonably adequate to serve the unreleased portions of the
Lan~ if developed for substantially the same purposes as the
development of the released portions of the Land, ingress and
egress from the unreleased partions of the Land aver such road
to Pruitt Road shall not be limited or restricted, and such
road shall be such that it can be extended into the unreleased
portions of the Land. Mortgagor does hereby grant bargain,
sell and convey to Mortgagee, for the benefit of the unre-
leased portions of the Land, a perpetual, non-exclusive ease-
ment over any private roads hereafter located on the released
oortions of the Land, for the purpose of ingress and egress to
and from Pruitt Road from and to the unreleased portions of
tne Land.
(b) No portion of the Land designated to be
released shall be released if the release would leave any por-
tion of the Land remaining subject to this Mortgage without
access to all utility facilities (including without
limitation, facilities for water, electricity, gas, sanitary
sewer and storm drainage) installed on released portions of
the Land which utility facilities shall have reasonably suf-
ficient capacity to serve the unreleased portions of the Lan~
if developed for substantially the same purposes as the deve-
lopment of *_he released portion of the Land. Mortgagor does
hereby grant, bargain, sell and convey to Mortgagee, for the
5enefi* ef the unrelease~ portions~of the Land, a aerpetual,
non-exclusive easement over the released portions of the Land
for the purpose of_ enabling Mortgagee to connect to, tie on or
tap into such utility facilities on the released portions of
the Land. ~
(c) No portion of the Land designated to be released
shall be released if the release would leave any portion of
the Land remaining subject to this Mortgage without access to
all recreational areas and related amenities constructed on
released portions of the Land, which areas shall be available
to the owners of unreleased portions of the Land on the same
basis as they are available to owners of the released portions
of the Land if such unreleased portions are developed for
substantially the same purposes as the released portion of the
