SECTION II1 <the "Condominium") according to the Declar-
ation of Condominium thereof ("Declaration">, recorded in
Official Records Book 341 at Pages 2403 through2 2
of the Public Records of St. Lucie County, Florida as t e
Declaration may have been amended by any amendments
recorded in the Public Records of St. Lucie County,
Florida including, but not iimited ta, any amendment to
add the aforesaid Phase to the Condominium (if such
Phase be other than Phase I thereof).

~ Grantee, by acceptance hereof , and by agreement wiih Grantor hereby
expressly assumes and ac~rees to be bound by and to comply with all of the
~ covenants, terms, conditions and provisions set forth and contained in the
aforedescribed Declaration of Condominium, including , but not limited to, the
~ obligation to make payment of assessments for the maintenance and operatioh
of the Condominium which may be levied against the above-described Apart-
R ment. Grantee expressly acknowledges the existence of a Settlement Stipula-
tion and Agreemeni for and Grant of Easements anc3 Other Rights• (the "Settle-
ment Stipulation") and a Decl~ration of Protective Covenants and Restrictions
(the "Protecdve Covenants" ), as well as the "Designation Notice" modifying
~ the Settlement Stipulation and Protective Covenants, all as hereinafter set
; forth. The SetUement Stipulation provides for this Condominium to be served
~ by certain faciiities of Nigh Point of f'ort Pierce Condominium Section 1 and
~ , the Protective Covenants pravides for certain tand use covenanis upon ihe
land ereas described therein ~including, bnt not limited to, portions of the
;~ land areas included within this Condominium) and prevides for certain drainage.
Pasements and other easements and rights including, but not limited to, the
~ "Roadway Easement" ,"Sewage System Rights" ,"Water System Rights" and
"Future Development Property Drainage Easement" , a!1 as are more particular- ~
ly described therein, all in addition to the other matters set forth in the
Settlement Stipulation and Protective Covenants, which other matters include,
but are not Iimited to, the abliqation to pay certain "Assessments" as are
respectively set forth in the Setilemeni Stipulation and Protective Covenants.
Grantee expressly acknowledges and assumes the obligation to pay the amounts
assessed against the Apartment under both the Settlement Stipulation and
Protective Covenants and acknowledges that "Assessments" under both the
Settlement Stipulation and Protec've Govenants against all properti~es now or ~
• hereafter included within this Condominium in accordance with the above- i
' described Declaration of Condominium are "Common EScpenses" of this Condomin- ~
ium as provided for in the Declaration of Condominium.
