HomeMy WebLinkAbout1762prior to entry of a judgment enforcing this Mortgage if: (a) Bortower pays Lender all sums which would be then due under this Mongage, the Note aod notes securing Future Adva~ca. it any, had no acceleration occurred; (b) Borrower cures all brcaches of any othe~ covenants or agrcements ot Borrowe~ contained in this Mortgage; (e) Borrower pays all ressonable expenses incurred by I.ender in enforcing the covenagts and agreeme~ts of Borrower contai~ed in this Mottgage and in enforci~g l.ender's remedies as provided in paragraph 18 hercof. including, but twt limited to. rcuonable attorney's fas; and (d) Borrower taka such action as [,ender may rcasonably requirc to assure that the lien of this Mortgage. Lender's interest in the Property and Borrower's obligation to pay the sums secured by this Mortgage shall continue unimpaircd. Upon auch paymcnt and curc by Borrower. this Mortgage and the obligatio~s securcd hereby shall remain in full force and effect as if no acceleration had occuroed. 20. As additional security hereunder, Borrower hereby assigns to l.ende~ the renta of the Propeny, provided that Borrowe~ shall, prior to acceleration under paragraph 18 hereof or abandon- ment o( the Property, have the right to collect and retai~ such rents as t6ey bocome due and payable. Upon acceleration under paragraph 18 hereof or abandonment of the Property, l.ender shall be eotitled to have a receiver appointed by a~~ourt to enter upon. take possession of anJ manage the Property and to collect the rents of the Property. including those put due. All rents collectaf by the receiver shall be applied first to payment of the costs of management of the Pmpeny and collection of rents, including, bat not limited to, receiver's Fees. premiums on rcceiver's bo~ds and reuonabk attorney's feu, and then ta the sums secured by this Mortgage. The roceiver shall be liable to account o~ly for those rents actually received. 21. Fnt~re Advaac~s, Upon requ~st by Borrower, l.ender, at [_ender's option within twenty years from the date of this Mortgage, may make Future Advances to Borrower. Such Future Advances, with interest thereon, shall be secured by this Mortgage when evidenced by promissory notes stating that said notes are secured hereby. At no iime shall the princepal amount of the indebtodness secured by this Mortgage. not including sums advanced in accordance herewith to protect the security of this Morigage. excced the original amou~t of Ihe Note plus USS . ............ ......•-•....... 22.
