HomeMy WebLinkAbout1832If the pro~ected construction costs exceed ~55,000 on the service center facility, Lessor shall have the privilege of reducing the siie of the facility, so that the construction costs can be kept below the E85,000. ARTICLE I1. TERM: TO NAVE AND TO HOLD the above rented and leased real estate, and a11 rights, privileges, easements and appurtenances thereunto belonging(herein referred to as "premises")for, and during the term of twenty(20)years, comnencing on the date spe- cified in the "Effective Date Agreement" attached hereto, and specifically made a part hereof by reference, to be executed by the parties hereto upon completion of the improvements herein agreed upon between them. ARTICLE III. RENTAL: The rental for the demised premises herein leased by Lessor to Lessee shall be the sum of TEN AND 00/100(~10.00)DOLLARS and other good and valuable considera- tions, more specifically referred to in Article I., Paragraph (c), Page One(1) of this lease agreement. Said rentals may be paid by Lessee's check, draft or voucher, payable to the order of Lessor, and mailed to Lessor at: 1750 Lullaby Terrace, Port Saint Lucie, Florida,33452, or to such other payee or address as Lessor may fram time to time hereafter designate in writing. ARTICLE IV. PERMITS: Lessee shall furnish at its sole cost and expense, the necessary consents and permits(with consent and cooperation and assistance from Lessor}which may be required by any governmental authority for the construction and instaliation of the desired buildings, structures, and improvements, including driveways and approaches over the sidewalks, parkways and curbing, and for installation and maintenance of tanks, pumps, signboards, light posts and lighting facilities, including illuminated signs, and other equipment and appliances for operating and conducting upon said premises a convenience store, motor fuel outlet, and a separate four(4)bay service center facility, including the greasing and servicing of automobiles, the making of minor replacements and repairs, and for the marketing of automobile tires, accessories, and other merchandise; ali, or one or more, branches thereof being the business which the parties hereto propose to ~onduct or cause to be conducted on said premises; Lessee reserving, however, the right to conduct or cause to be conducted thereon any lawful business. In the event Lessee shall be unable to obtain said permits within one hundred eighty(180)days from the date hereof, Lessee shall. have the option of cancelling and terminating this lease by notice to such effect to Lessor; and, in the event this lease is so terminated, Lessee shall not be liable to Lessor on account of any cove- nants or obligations herein contained. ARTICLE V. IMPROVEMENTS: Lessee shail have the right to erect, install, maintain and operate on said pre- mises such buildings, structures, improvements, equipment, fixtur~s(trade or otherwise) and appliances(with the right of removal as hereinafter more specifically provided) on, under, and above the ground as it may require or desire in the conduct of the business to be conducted on said premises. Lessee shall have the further right to make, at its expense, such additions to or alterations in the buildings, structures, and improve- ments as Lessee shall deem desirable or necessary to make connections with any water, gas, and sewer lines, and pipes on or serving the demised premises, and to continue the use and service thereof durin the term of this lease.
