MAINTENANCE AND UPKEEP:
Lessee hereby agrees to maintain, at its own expense, in good condition and
repair, the convenience store, motor fuel facility structure, alon~ with drive-
ways of the facility.
Lessor hereby agrees to maintain at its own expense, in good condition and
repair, the four(4)bay service center facility structure, along with driveways
of the facility.
Lessee,at its expense, may make any changes or alterations in such buildings,
improvements, structures and property, as it should deem necessary.
ARTICLE VII.
TAXES AND ASSESSMENTS:
Lessor agrees to pay all general real estate taxes and special assessments
leviRd and assessed and to be levied and assessed on said premises while this
lease remains in force. Upon receipt of tax h~ll fran Lessor, showing that all
taxes on the demised premises have been paid each year, Lessee will reimburse
Lessor for that percentage of said taxes attributable to Lessee's convenience
store, motor fuel facility(imprnvements only) which shall be based upon the square
footage of the buil.ding, as prorated on the entire square footage of the building
improvements on the property.
In the event Lessor shall default in the payment of any real estate and special
assessment taxes levied against the premises during the term of this lease, Lessee
shall have the option of paying said tax~s on b~ehalf of Lessor, in order to prevent
said property being tendered over by Tax Deed. In the event such option must be
exercised by Lessee to protect Lessee's interest~in and to the demised premises,
Lessor hereby agrees to reimburse lessee the amount of said taxes, plus interest
at the rate of eighteen(18%)percent per ~nnum.
ARTICLE VIII.
INSURANCE:
Lessee shall provide and carry the necessary and required liability, fire and
extended coverage insurance, on the convenience store and mntor fuel facility.
Lessor shall provide and carry the necessary liability insurance and required
fire and extended coverage insurance on the service center facility. Lessee shall
be named as loss payee under the fire and extended coVerage policy, and shall be
furnished with a Certificate of Insurance, as proof of said coverage.
ARTICLE IX.
LICENSES AND OCCUPATIONAL CHARGES: ''
Lessee shall be liable and responsible fofi the license fees and occupational
taxes covering the conduct of its business, and all charges for water, and
gas, electric, and any other public utility or service, used by Lessee, and agrees
to pay the same th'roughout the term of this lease.~" "
