WITNESSETl~:
That Grantor, for and in considerati~n of the sum of TEN _(t10.00)
DOLLARS and other good and vatuable consideration paid by Grantee, the
receipt of which is hereby acknowledged, has f~ranted, bargained, and sold to
Grantee a nd Grantee's heirs and assigns forever, the following described real
property situated, lying and being in St. ~ Lucie County, Florida, to-wit:
The Condominium Farcel known as Apartment ~'3'3-;; of
Phase II of HIGH POINT OF FORT PiERCE CONDOMINIUM
SECTION III (the "Condominium") according to the Declar-
ation of Condominium thereof ("Declaration"), recorded in
Official Record~ Book 341 at Pages 2403 through2542
of the P~sblic Records of St. Lucie County, Florida as the
Declaration may have been amended by any amendments
recorded in the Public Records of St. Lucie County,
F'lorida including, but not limited to, ar.y amendment to
add the aforesaid Phase to the Condominium (if such
Phase be other than Phase I thereof). .
~ Grantee, by acceptance hereof , and by agreement with Grantor hereby
expressly assumes and agrees to be bound by and to comply with aii of the
covenants, terms, conditions and provisions set forth and contained in the
~ aforedescribed Declaration of Condominium, including, but not limited to.,~ the
~ obligation to make ~ayment of assessments for the maintenance and operation ,
il of the Condominium which may be levied against the above-described Apart- I
~ ment. Grantee expressly acknowledges the existence of a Settlement Stipula-
'on and Agreement for and Grant of Easement~ ~and Other Rights~ (the "Settle- ~~
ment Stipulation") and a Declaratior. of Protective Covenants and Restrictions
(the "Protective Covenants"), as cvell as the "Designation Notice" modifying
o the Settlement Stipulation and Protective Covenants,' a!1 as hereinafter set
~ iorth. The Settlement ~tipulation provides for this Condominium to be served
~i by certain facilities of High Point of Fort Pierce Condominium Section 1 and
the Protective Covenants Frovides for certain land use covenants upon the
land areas described therein <including, but r.ot limited to, portions of the
~ land areas included within this Condominium) and provides for certain drainage
Pasements and other easements and rights including , but not limited to, the -
"Roadway Easement" ,"Sewage System Rights" ,"1n'ater System Rights" and ~~
~ "Puture Development Propet'ty Drainage Easement" , all as are mare particular-
;~ ly described therein , al1 in addition to the ather mattErs set forth in the
;~ Settlement Stipulation and Protective Covenants, which other matters include,
but are not limited to, the obligatior. to pay certain "Assessments" as are
~ respectively set forth in the Settlement Stipulation and Protective Covenants.
Grantee expressly a~knowledges and assumes the obligation to pay the amounts
~ assessed against the Apartment under both the Settlement Stipulation and
~ Protective Covenants and acknowledges that "Assessments" under both the
~' Settlement Stiputation and Protective Covenants againsi all properties now ar
a hereafter included within this Condominium in accordance with the above-
described Declaration of Condominium are "Common Expenses" of this Condomin-
ium as provided for in the Declaration of Condominium.
