This cause coming on to be heard on the Defendant's
Motion to Dismiss the Complaint and the Plaintiff's Motion to
Compel Answers to Interrogatories and the Court being fully
advised in the premises, it is hereby
ORDERED AND ADJUDGED that Defendant's Motion to Dis-
miss is granted and Plaintiff shall have thirty (30) days to
amend the Complaint, it is further
ORDERED AND ADJUDGED that Plaintiff's Motion to Com-
pel Answers to Interxogatories is granted and Defendant shall
answer within twenty (20) 'days Intezrogatories 1 through 13
inclusive of those certain set of Interrogatories served on
November 20, 1980 subject to the following:
As to Interrogatories 3 and 8, the answer shall
assume the motor vehicle stated therein is the motor
~
vehicle refezred to in the Complaint. Further as to
Interxogatory 5, the defects shall be deemed to read
"the alleged defect". Further as to Interrogatoary 7
this will be answered as to the last year of employ-
ment of the Plaintiff. Further~as to Interxogatory
9, the grove referred to will be considered the grove
refexred to in the Complaint.
