THIS INDENTURE, made thia 2Z day of Januar~, A.D. 1981.
BETWEEN ~~ON R. TUSTIN hereinafter called the
Mortgagor. and SHIRLEY K. BEMENDERFER hereinafter called the
MORTGAGEE,
WITNESSETH, That the said Mortgagor, for and in consideration of
the sum of One Dollar, to THREE THOUSAND ONE Ht'NDRED T~IENTY FIVEDOLLARS
in hand paid by the said Mortagee, the receipt whereof is hereby
acknowledged, and granted, bargained and sold to the said
Mortgagee, SHIRLEY K. BEMENDERFER • ,
heirs and assigns forever, the following described land situated,
lying and being in the County of ST. LUCI~ ,
State of FLOR~DA to wit:
GREEN ACRES S/D. Lot7, Block 5, of Unit 3, together with all
improvments thereon including one tWO bedroom one bath mobile
home , and
GREEN ACRES S/D. Lot 8, Block 5 of Unit 3, together with all
improvments thereon including one doublewide fhree bedroom,
one and one-half bath mobile home.
And the said Mortgagor do hereby fully warrant the title to said
land, and will defend the same against the lawful claims of all
persons whomsoever.
PROVIDED ALWAYS, That if.said Mortgagor, VE~tNON R. TUSTIN
Heirs, legal representatives or assigns shall pay
unto the said Mortgagee. SHIRLEY Kr BEME~IDERFER l.egal rep-
resentatives oz assigns, certain promisaory note dated the~1
day of Janu~,ry 1981, for the sum of Three thousand one hundred
Z'aenty-five dollars, payable on March 9, 1981~ at no interest,
and shall perform, comply With and abide i~y each this mortgage, -
and shall pay all taxes that may accreu on said land and all
cost and expenses said Mortgagee may be put to in collecting said
prcimissory note by foreclosure of this mortgage or ~otherwiee,
including a reasonable attorney's fee, then thia mortgage and the
estate bereby created shall cease and be null and void.
IN WITNESS WHEREOF, the said Mortgagor hereunto set his .
