3. The Trustee shall not have th~ power to make, execute
or deliver warranty deeds, leases, mortgages or other instruments
of transfer or conveyance or to.otherwise deal with the Property
except with the prior written consent and instruction of the
beneficiary.
4. This Declaration shall not be deemed to create or
evidence the existence of a corporation de facto or de jure, or
a Massacnusetts trust or association in the nature of a corpor-
ation, or a co-partnership, but shall solely be deemed to have
been entered into for the purpose of creating a Trust with
respect to the Property for the uses and purposes hereinabove set
forth.
