THIS CAUSE, having come on to be heard upon the Motions
of the Defendants, WILLIAM J. BOSSO, LUISA R. BOSSO, and JOSE
SOTOLONGO, before the Honorable Philip G. Nourse, on the 20th day
of February, 1981~ and the Court having considered the Motions
of the Defendants and arguments of counsel, it is hereby
ORDERED AND AflJUDGED:
1. The Motion of the Defendant~ JOSE SOTOLONGO, to
Dismiss Count ~ of the Plaintiffs' Complaint is denied.
2. The Motion of the Defendant, JOSE SOTOLONGO, to
Strike Allegations of Count I is denied, conditioned upon the
Plaintiffs filing an amendment conforming the original Complaint
as indicated in Paragraph 5(B) of the Defendant, JOSE SOTOLONGO'S „
Motions.
3. The Motion of the Defendant, JOSE SOTOLONGO, for
More Definite Statement with respect to Count I of the Plaintiffs'
Complaint is denied.
, 4. The Defendant, JOSE SOTOLONGO, having failed to argue
his Motion to Dismiss Count II of Plaintiffs' Complaint, as
contained in Paragraphs 10 through 12, is hereby denied.
, 5. The Motion of the Defendant, JOSE SOTOLONGO, to '
Strike and for More Definite Statement With Respect to~Count II is
denied.
6. The Motion of the Defendant, JOSE SOTOLONGO, to
Dismiss Count IV of the Plaintiffs' Complaint is granted with
respect to Paragraphs 20 and 24. The Plaintiffs shall have thirty
