for damages, direct or consequential, in connection with any
condemnation or other taking of all or any part of the Property,
direct or indirect, or for conveyances in lieu of condemnation,
shall be paid one-eiyhth to the liortgagor and seven-eighths to
the riortgagees. The riortgagor authorizes the liortgagees to apply
the Mortgagees' share of the proceeds, after deduction of the
t4ortgagees' expenses incurred in their collection, at the Mortgagees'
option, to payment of *.hV' _T:?dA~*_edness, whether or not then due,
in the order of priority set forth in Section 2. Unless the
Mortgagor and the Mortgagees otherwise agree in writing, any appli-
cation of such proceeds to principal shall not-extend or postpone
the due date of any payment uncler the t7ote.
(c) Any settlement_or compromise of any such
condemnation proceeding shall require the written approval of the
Mortgagor and the Mortgagees.
(d) Nothing contained in this Section 7 shall
prevent or inhibit Mortgagor from exercising its rights under
paragraph 5{e)(2) of the Purchase Agreement and Escro~a Instructions
attached as Exhibit I to the Note for which this *lortgage Deed
stands as security.
8. Borrower and Lien r~ot Released. From time to time .
the riortgagees may, at their option, without giving notice to or ~
obtaining the c~nsent of the l~ortgagor, its successors or assigns,
or any junior lienholders or guarantors, without liability on the .
Mortgagees' part and notwithstanding the l~ortgagor's breach of any ~
