HomeMy WebLinkAbout2967 ~ ~ - 13 - (d) The Mortgagor will execute and deliver a release instrument within 30 days after receipt of the Mortgagor's request for release, accompanied by a survey, a metes and bounds description of the portion of the Property to be released, copies of the construction loan commitment,building permit or permits (in the case of a release under Subsection (a)) and a release in- strument in proper form and ready to be executed. The Mort,gagor shall pay all costs and expenses of the Mortgagees in connection with each such release, including but not limited to recordation fees, recordation taxes, and attorneys' fees, and those costs and expenses shall be paid sir.-u2taneously with the :~Iortgaqees' etecution of the release instrument, but if not then paid they shall be added to and become part of the Indebtedness. 17. Additions to Indebtedness. Al.l costs and expenses of the Martgagees which are added to and become part of the Indebted- ness under this Mortgage shall be due and payable to the Mortgagees, without demand by the :4ortgagees, within 30 days after they are added to the Indebtedness. 18. Representations of Mortgagor. The Mortgagor represents to the riortgagees that it is a corporation organized, duly existing, and in goad standing under the laws of the State of Florida, that the execution of this Mortgage has been properly authorized by its Board of Directors, and that it has full corporate power and authority to grant, execute, and deliver the Note and this t4ortgage. 19.
