FOURTH: I give and devise such of my tangible personal
property to those'persons designated in a separate writinq in
existence at the time of my death, which list is signed by me and
which describes the items and the devisees with reasonable certainty.
FIFTH: I hereby constitue and appoint my husband, WYNFRED
ROSCOE BRIGGS, Executor of this my Last Will and Testament, and I
expressly confer upon him power as such Executor to administer r.~y
estate, excusing him from giving any bond, or making any returns to
any court. I expressly confer upon him full authority and power to
manage, invest and re-invest, and to sell and convey any part or
all of my estate, at public or private sale, with or without notice,
as he may deem best, and without any order of court. I authorize
him to make good and sufficient conveyances to any purchaser arid to
hold the proceeds of any sale for such use as he may deem best for
the interest of my estate. I further hereby expressly confer upon
him the authority and power to borrow money for the use of my said
estate in any instance where he may think it necessary and proper,
and to secure the same by mortgage, trust deed, or other form of
security to or upon any part of my estate; this he may do without
the order of any court.
If my husband fails to survive me or if he fails to qualify
as Executor, I appoint my son, JAMES OZRO BRIGGS, as alternate
Executor of this my Last Will and Testament with the same rights
and privileges as my husband would have had if he had survived me.
IN WITNESS WHEREOF I have hereunto subscribed my hand and
seal, and publish and declare this instrument to be my Last Will
and Testament, in the presence of the witnesses named hereinafter,
on this the ~~;,.)M day of June, in the year of our Lord, One Thou-
sand Nine Hundred Seventy-Six.
