This cause having come on before the Court on the
Motion to Dismiss Plaintiff's Amended Complaint by Defendants,
GULF OIL REALTY COMPANY, HARRISON LAND DEVELOPMENT, INC. and
HUTCHINSON ISLAND LIMITED, INC., and the court having received
argument of counsel and being otherwise fully advised in the
premises,
It is ORDERED and ADJUDGED:
1. The Motion to Dismiss of Defendant, HUTCHINSON ISLAND
LIMITED, INC., be and the same is hereby granted, with leave
to Plaintiff to file a second amended Complaint within twenty
(20) days from the date of this Order. Said Defendant shall
have twenty (20) dags after filing of the Second Amended Com-
plaint within which to file a responsive pleading.
2. The Motion to Dismiss of Defendants, GULF OIL REALTY
COMPANY and HARRISON LAND DEVELOPMENT, INC. be and the same
is hereby denied. Said Defendants shall have forty (40) days
from the date of this Order, or twenty (20) days from the c~ate
of filing of Plaintiff's Second Amended Complaint, whichever
date shall first occur, to file t eir answer.
