NOTICE IS HEREBY GIVEN to the Defendants, ROGER'S L& S,
INC., a Florida corporation, d/b/a ROGER'S FURNITURE WAREHOUSE,
and ROGER J. SASS, SR., that they have the right to fiwe Affidavits
in their behalf with the Court and may personally appear at the time
and place set forth above or by way of an attorney and present
testimony and evidence on his, her or its behalf, and if, upon a
finding by the Court, that the Plaintiff is entitled to possession
of the claimed property, pending final adjudication of the claims
of the parties, file with the Court a written undertaking, executed
by a security approved by the Court in an amount equal to the
value of the property to stay an Order authorizing the delivery of
the property to the Plaintiff.
NOTICE IS FURTHER HEREBY GIVEN to the Defendants, that if
they fail to appear, it shall be deemed that each has waived
his, her or its right to a hearing and in such case, the Court
may Order the Clerk of the Court to issue a Writ of Replevin
directing delivery of possession of the claimed property to the
Plaintiff; and the Defendants are further advised that they may
waive the right to a hearing by signing the Waivers attached to
the Summons and filing the same with the Court and a copy upon
the Plaintiff's attorney, on or before the date for the hearing
hereinabove set forth.
