WITNESSETH: That Grantor, for and in consideration of the sum of TEN (510.00) DOLLARS and other qood and valuable consideration ~aia by Grantee, the receipt of which is hereby acknowledged , has granted , barga~ined , and sold to Grantee and Grantee's heirs and assigns forever the following described real property situated, lying and being in St. Lucie County, Florida, to wit: The Condominium Parcel known as Apartrnent 1212A of Phase X~ of HIGH POINT OF FORT PIERCE CONDOMINIUM SECTION II (the "Condominium"~ according to the Declara- tion of Condominium thereof , recorded in Official Records Book 304 at Pages 1396 through 1508 of the Public Records of St. Lucie County, Florida as such Declaration may have been amended by any amendments thereto hereto filed in the Public Records of St. Lucie County, Florida includfng, but not limited to, any amendment to add the aforesaid Phase to the Condominium (if such Phase be other. than Phase I thereof ). Grantee, by acceptance hereof, and by agreement with Grantor hereby expressly assumes and agrees to be bound by and to comply with all of the covenants, terms, conditions and provisions set forth and contained in t}ie aforedescribed Declaratfon of Condominium, including, but not limited to, the obliqation to make payment of assessmenLs for the maintenance and operation of the Condaninium which may be levied against the above described Apart- ment. Grantee expressly acknowledges the existence of a Settlement Stipula- tion and Aqreement for and Grant of Easements and Other Rights (the "Setde- ment Stipulation" ) and a Declaration of Protective Covenants and Restricttons (the "Protective Covenants" ), as hereinafter set. forth . The Settlement Stipu- lation provides for this Condominiwn Lo be served by certain facilities of High Point of Fort Pierce Condominiwn Section 1 and the Protective Covenants provides for certain land use covenants upon the land areas described therein ~including, but not limited to, portions of the land areas included within this Condominium) and provides for certain drainage easements and other ease- ments and riqhts including, but ~not limited to, the "Roadway Easement", "Sewage System Rights" ,"Water System Riqhts" and "Future Development" Property Drainage Easement", all as are more particularly described therein, all in addition to the other matters set forth in the Settlement Stipulation and Protective Covenants, which other matters include, but are not limited to, the obligation to pay certain "Assessments" as are respectively set forth in the Settlement Stipulation and Protective Covenants . Grantee expressly- acknowl- edges and assumes the obligation to pay the amounts assessed against the Apartrnent under both the Settlement Stipulation and Protective Covenants and acknowledges that "Assessments" un~der both the Settlement Stipulation and Protective Covenants against all properties now or hereafter inciuded within THIS INSTRtJMENT PREPARED 8Y: BIJRTON A.
