AFTER DUE NOTICE by or to all parties affected, a
Hearing was held before the Court with respect to the matters
disposed of by this Order; upon consideration, it is
ORDERED AND ADJUDGED that the Motion to-Dismiss ttie
~ claim of the Plaintiff, i~iICHAEL B. WALLRATH~ for a recon-
veyance of the real property which forms the subject matter
of this litigation is dismissed, and all references to said
claim cen~ained in the Complaint are stricken. It is further
ORDERED AND ADJUDGED that the undersigned reserves
ruling on the Motion to Dismiss the claim to impose a con-
structive or resulCing trust in the real estate which forms
the subject matter of this litigation, and the Plaintiffs
shall have ten (10) days from the date of this Order in which
to file a Memorandtm~ of Law in support of their contention
that they are entitled to the imposition of such a trust; '
upon service of such Memorandum, Che Defendant shall have
ten (10) days in which to f ile a response .
