THIS CAUSE having come on to be heard upon the Plaintiff's
Motion For Partial Summary Judgment and the Plaintiff's Motion For
Dismissal of Defendant's Counterclaim and the Court having heard
arguments of counsel and having otherwise been advised in the
premises, it is ~
ORDERED AND ADJUDGED that the Plaintiff's Motion For Partial
Summary Judgment as to Counts I and II of its Complaint is hereby
granted, it is
ORDERED AND ADJUDGED that the Plaintiff's Motion To Dis-
miss Defendant's Counterclaim is hereby granted without prejudice
and the Defendant is hereby given twenty (20) days from the date of
this Order to herein file his Amended Counterclaim.
DONE AND ORDERED at Fort Pierce, St. Lucie County, Florida,
on this day of March, 1981.
