Apartment owner, dwelling owner, and unit owner means unit owner as defined by the condomi in~i.im Act and, the terms apartment owner, dwelling owner, and unit owner shall be used interchangeable in this Declaration of Condominium and have the same meaning. ' C. Association means INDIWE 00[V~[M, INC. as lawfully amended from time to time and its successors and assigns. D. Assessment means a share of the funds required for the payment oz common expens~s, whic:h irom ~i~~e t~ time is assessed against the unit owner. E. Common elements means the portions of the Condominium property not included in the units, including tangible personal property owned by the Association and required for the operation of the Condominium, all of the real property improve- ments and facilities of the Condominium other than the apartment units and limited common elements, including but not by way of limitation, pipes, ducts, plumbing, wiring, roadways, lawn areas, landscaping, facilities for furnishing utilities and easements therefor for the maintenance and operation of the Condominium, even though owned by the Association, for the joint use and benefit of all the unit owners, as well as the items stated in the Condominium Act. F. Common expenses include: i. Expenses of Administration, expenses of maintenance, operation, repair or replacement of the common . elements and of the portions of the Iimited common elements and apartment units to be maintained by the Association. ii. Expenses declared common expenses by the provisions of this Declaration of Condominium, the By-Laws and the Condominium Act as amended. iii. Any valid charge against the Condominium property as a whole which includes the expenses of operating INDIWE CONDOMINIUM, INC. G. Common surplus means the excess of all receipts of the Association, including, but not limited to, assessments, rents, profits and revenues on account of the common elements, over the amount of common expenses of-this Condominium. H. Board of Directors means the representative body of the Association responsible for the administration, opera- tion and management of the Condominium. I. BY-LAWS means the By-Laws of the Association existing from time to t me. J. Condominium means that form of ownership of real property which is created pursuant to the provisions of Chapter 718, Florida Statutes, as amended from time to time and which is comprised of units that may be owned by one or more per- sons, including an undivided share in the common elements appur- tenant to each unit. K. Condominium parcel means a unit, together with ~nd undivided share in the common elements which is appurtenant to the unit. L. Condominium property means the real property, leaseholds, and tangible personal property that are subjected to condominium ownership, whether or not contiguous, and all -2- ~~ox350 PAGE1S59
