Declaration; Declaration of Condominium means the instrument or instruments by which a condominium is created, as they are_from time to time amended. N. Limited common elements means those common elements which are reserved for the use of a certain condominium unit or units to the exclusion of other units, as specified in the Declaration of Condominium. O. Owner-member means record title holder of an apartment unit or a part thereof, the singular to include joint vwnzr5 whzr~ applieable. • P. Ownership interest means record title interest in an apartment unit or a part thereof. Q. Regulations means regulations respecting the use of the condominium~property that have been adopted by the Association from time to time in accordance with its Articles of Incorporation and By-Laws. . R. Utility services means as used in the Condominium Act and as construed with reference to this Condominium, and as used in the Declaration and By-Laws, shall include, but not be limited to, electric power, gas, hot and cold water, heating, refrigeration, air conditioning, garbage and sewage disposal. S. Singular, plural, gender. Whenever the context so permits, the use of the plural shall include the singular, and the singular shall include the plural, and the use of any gender shall be deemed to include all genders. T. Voting rights means those rights of a member of the Association to vote upon matters at properly called and constituted meetings of the Association. ~ U. Special assessment means a share of the funds required for the payment of common expenses which are unbudgeted or for which insufficient provision is made in the budget, occasioned by unforsseable and fortuitous events, which from time to time is assessed against the unit and unit owner. ARTICLE III DEVELOPMENT PLAN A. The Condominium shall consist of one (2) apartment builciing containing a total of ten(10) apartment units, and the facilities appurtenant thereto as, or to be constructed and installed by the Developer. A survey of the land and a graphic description of the improvements on which the apartment units are located, together with a plot plan thereof is attached hereto as Exhibit "A" and made a part hereof by reference. B.~~Improvements--completion period. At the time of filing this Declaration, certain of the improvements to be provided pursuant to the terms hereof have not been substantially completed and this Declaration will be amended'by filing additional plans, specifications, drawings or other documents as may be required by the Condominium Act to indicate subs-tantial completion of the construction of the Condominium. Said completion may be shown by a certificate of an ar~hitect, engineer or surveyor certifying that the improvements have been constructed substantially as herei~ represented, or designation any changes made. Such plans or certificates, when signed and acknowledged by the Developer and filed of record, shall in themselves constitute an amendment of this Declaration, notwithstanding the procedures for amendment described elsewhere in this Declaration. -3- BO~X~c~ PACE~~jo
