Common elements, as the term is used herein, shall consist of the real property and all improvements of the condominium lying wholly outside of the boundaries of the individual apartment unit as hereinbefore described and defined. Common elements shall also include all load-bearing and exterior walls, easements through apartment units for all pipes, ducts, plumbing, wiring and other facilities for the furnishing of u.tility services to other apartment units, and common elements and easements for support in every portion of an apartment unit which contributes to the support of the improvements wherever located, and all other improvements and tangible personal property reasonably consic~ered to be of common use or necessary to the existence and upkeep of the eondominium and the safet}~ of the unit owners, their guests, invitees and ~ther persons having access to the condominium excepting therefrom any limited common elements as further described herein. ARTICLE V OW:.ERSHIP OF APARTMENT.UNITS AND APPURTENANT INTEREST IN COMMON ELEMENTS ~ Each apartment unit shall be conveyed and treated as an individual property capable of independent use and fee simple ownership, and the owner or owners of each said apartment unit shall own, as an appurtenance to the ownership of each said apartment unit, an undivided interest in the common elements, the undivided interest appurtenant to each said apartment unit being that which is hereinafter specifically assigned thereto. The percentage of undivided interest in the common elements assigned to each apartment unit shall not be changed except with the unanimous consent of all the owners of all the apartment units. A. Separation of common elements or property. The undivided interest in the common elements or common property declared to be an appurtenance unto each apartment unit shall not be conveyed, devised, encumbered or otherwise dealt with se~arately from said apartment units, and the undivided interest in the common elements appurtenant to each apartment unit shall be deemed conveyed, devised, encumbered or otherwise included with the apartment unit, even though such undivided interest is not expressly mentioned or described in the instrument mnveying, devising, encumbering or otherwise dealing with such apartment unit. Any conveyance, mortgaqe or other instrument which purports to affect the conveyance, devise or encumbrance or which purports to grant any right, interest or lien in, to or upon an apartment shall be null, void and of no effect insofar as the same purports to affect any interest in an apartment unit and its appurtenant uncfii~•ic3ec~ interPSt in crmm~n elements, unless the same pur~orts to - S- a~350 P~1662
