HomeMy WebLinkAbout1668C. Right of Entry for Maintenance and Repair of Common Elements. Whenever it is necessary to enter a~y apartment unit for the purpose of performing any maintenance, alteration or repair to any portion of the common elements, or to go upon any limited common element for such purpose, the unit owner of each apartment unit shall permit other owners or their representatives, or the duly constituted and authorized Agent of the Association, t o enter such apartment unit, or to go upon the limited common elements, constitutinq an appurtenance to any such apartment unit, for such purposes, provided that such entry shall be made only at re~sonable times and with reaso~able advance notice. ARTICLE X LIMITATION UPON RIGHT OF OWNERS TO ALTER AND MODIFY APARTMENT UNITS No owner of an apartment unit shall permit there to be any structural modifications or alterations in such apartment unit without first obtaining the written consent of the Association which consent may be withheld in the event that a majority of the eoard of Directors of said Association determine in their sole discretion that such structural modifications or alterations would adversely affect the condominium or in any manner be detrimental to the Condominium in part or in its entirely. If the modifications and alterations desired by the owner of any apartment unit involves the removal of any permanent interior partition, the Association shall have the right to permit such removal so long as the permanent partition to be removed is not a load-bearing partition, and so long as the removal thereof would in no manner affect or interfere with the provision of utility services constituting common elements located therein. No owner shall cause any balcony or porch, if applicable, abutting his apartment unit to be enclosed or cause any improvements or changes to be made to the exterior of the apartment unit, including painting or other decoration, or the installation of electric a~iring, television antenna, machines or air-conditioning units, or any other objects which may protrude through the walls or roof of th~ Condominium, or in any ~anner chanqe the appearance of any ~ortion of the apa~rtment building not within the walls of such apartment unit, witho~t the written consent of the Board of Directors of the Association being first had and obtained. ARTICLE XI RIGHT OF ASSOCIATION TO ALTER AND IMPROVE PROPERTY AND ASSESSMENT THEREFOR The Association shall have the right to make or cause to 5e made such alterations, improvements or repairs to the common elements, provided the making of such alterations, improvments or repairs are approved by the Board of Directors of said Association and the cost of such alterations, improvements or repairs shall be assessed as common expense to be assessed and collected from all the unit owners of apartment units subject to assessments as herein set forth. However, where any alterations, improvements or repairs are exclusively or substantially exclusively for the benefit of the owner or owners of an apartment unit or apartment units requesting the same, then the cost of such alterations, improvements or repairs shall be assessed aqainst and collected solely from the owner or owners of the apartment unit or units exclusively or substa~tially exclusively benefited, the assessment to be levied in such proportion as may be determined by the Board of Directors of the Association. -9- 80in ~c~ PACf ~lll1V
