ARTICGE XXIII TF,RMINATION The Condominium may be terminated in the following rnanner in ac~dition to the manner provided by the Condominiu~r~ Act: A. Destruction. Notwithstanding any to the contrary contained in Article xV, in the event of fire or other casualty or disaster which sha12 destroy the apartment units in this Condominium as to require more than four-fifths (9/S) of the building to be reconstru~ted as determined by the Board of Directors of the Association, the~, this Declaration and the Condominium established hereby shall terminate, unless all of the unit owners of such apartment units agree that the said building shall be reconstructed, or unless any policy or policies of casualty insuran~e which may caver the damage or destruction of said building requires the re~onstruction thereof as a condition precedent to the payment of insurance proceeds ander such policy or Poli~ies, but notwithstandinq the fact that the unit owners of all apartment units aqree to reconstruct said building, or if such policy or poli~ies of casua]ty insurance require the same to be -26- ~~~350 P~1S83
