Association, provided however, that such amendments do not
decrease the owners' ~hare in the mrt-r~~on elements, change their
voting rights, or affect materially the riqhts of the unit o~ners
in any way or the value of the apartment units owned without the
written approval of the unit owners.
ARTICLE XXI
USE OR ACQUISITIOh OF INTEREST IN THF CONDOMINIUM TO
RENDER USER OR ACQUIRER SUBJECT TO THIS DECLARATION OF
C~ND~MINIilM AND RULES AND R~CL'LATIaNS
All present or futute owners, tenants or any other
person who might use the facilities of the Condominium in any
manner whatsoever are subject to all the provisions of this
Declaration of Condominium, Articles of 7ncorporation of the
Association, By-Laws of the Association, and all Rules and
Regulations of the Association and Condominium Act, and all
documents appurtenant hereto are incnrporated herewith and the
mere acquisition or rental of any apartment unit, or the mere acts

provisions of this Declaration of Condomini~m and such documents
as herein described are accepted and ratified in all respects.
ARTICLE XXII
RIGHT OF DEVELOPER TO SELL OR LEASE APARTM£NT UNITS
OWNED BY IT FREE OF RIGHT OF FIRST REFUSAL
So ?ong as the Developer shall own any apartment unit
the said Developer shall have the absolute right to lease, sell,
transfer, and/or convey any such apartment unit to any person,
firm or corporation, upon any terms and conditions as it shall
deem to be in its own best interest, and in connection herewith
the right of first refusal herein granted to the Association shall
not be ooerative or effective in any manner as to the Developer. _

i7ec2aration of Condomini~m, Articles of Incorporation, B~-~aws of
the Association, Rules and Regulations and Condominium Act, are
freely assignable in whole or in part by Developer and may be
exercised by the nominee of neveloper and/or exercised by the
successor or successors in interest of tt~e Developer.
ARTICGE XXIII
TF,RMINATION
The Condominium may be terminated in the following
rnanner in ac~dition to the manner provided by the Condominiu~r~ Act:
A. Destruction. Notwithstanding any to the
contrary contained in Article xV, in the event of fire or other
casualty or disaster which sha12 destroy the apartment units in
this Condominium as to require more than four-fifths (9/S) of the
building to be reconstru~ted as determined by the Board of
Directors of the Association, the~, this Declaration and the
Condominium established hereby shall terminate, unless all of the
unit owners of such apartment units agree that the said building
shall be reconstructed, or unless any policy or policies of
casualty insuran~e which may caver the damage or destruction of
said building requires the re~onstruction thereof as a condition
precedent to the payment of insurance proceeds ander such policy
or Poli~ies, but notwithstandinq the fact that the unit owners of
all apartment units aqree to reconstruct said building, or if such
policy or poli~ies of casua]ty insurance require the same to be
