~ That Grantor, for and in consideratiun of the sum of TEN (t10.00)
~. DOLLARS and other good and valuable consideration paid by Grantee, the
receipt of which is hereby acknowledged, has granted, bargained, artd sotd to
` Grantee .attd Grantee's heirs and assigns forever , the following described real
property situated, lying and being in St. Lucie County, Florida, to-wit:
The Candominium Parcel known as Apartment g~~ of
Phase ~ of HIGH POINT OF FORT PIERCE COND~OMINIUM
SECTION III (the "Condominium" ) according to the Declar-
ation of Condominium thereof ("Declaration" ), recorded in .
Official Records Book 341_ at Pages 2403 through2542
of the Public Records o~ St. Lucie County, Florida as the
Declaration may have been amended by any amendments
recorded in the Public Records of St. Lucie County,
Florida including, but not limited to, any amendment to
add the aforesaid Phase to the Condominium (if such
Phase be other than Phase I thereof).
Grantee, by acceptance hereof, and by agreemeni with Grantor hereby
expressly assumes and agrees to be bound by and to comply with all of th~
covenants, terms, canditions and provisions set forth and contained in the
aforedescribed Declaration of Condominium, including, but not limited to, the
obliqation to make payment of assessments for the maintenance and operation
of the Condominium which may be levied against the above-described Apart-
ment. Grantee expressly acknowledges the existence of a Settlement Stipula-
t3on and Agreement for and Grant of Easements and Other Rights- (the "Settle-
ment Sttpulation") and a Declaration of Protective Covenants and Restrtctions
(the "Protective Covenants"), as well as the "Designation Notice" modifying
the Setdement Stipulation and Protective Covenants, all as hereinafter set
forth. The Settlement Stipulation provides for this Condominium to be served
by ceriain facilities of High Point of Fort Pierce Condominium Section 1 and
the Protective Covenants provides for certain land use covenants upon the
land areas described therein (including, but not limited to, portions of the
land areas included within this Condominium) and provides for certain drainaqe
p.asements and other easements and rights including, but not limited to, the
"Roadway Easement", "Sewage System Rights", "Water System Rights" and
"Future Development Property Drainage Easement" , a!1 as are more particular-
ly described thereir , all in addition to ihe other maiiers set forth in the
Settlement Stipulation and Protective Covenants, which other matters include,
but are not limited to, the obligation to pay certain "Assessments" as are
respectively set forth in the Settlement Stipulation and Protective Covenants .
Grantee expressly acknowledges and assumes the obligation to pay the amounts
assessed aqainst the AparUnent under both the Settlement Stipulation and
Protective Covenants and acknowledges that "Assessments" under both the
Setdement Stipulation and Protective Covenants against all properties now or
hereafter included within this Condominium in accordance with the above-
described Declaration of Condominium are "Common Expenses" of this Condomin-
ium as provided for in the Declaration of Condominium.
