HomeMy WebLinkAbout2211 1 (4) Matntenance: Blanket non-exclusive easements are reserved throughout the common and limited conm:on areas of the Condominium Property, for maintenance purposes in order to adequately maintain such areas. (5) Access: Each Unit Owner and any officer, agent, employee or designee of the Association or member of the Board of Directors of the Association shall have access across any limited common elements for the purpose of ingress and egress. (6) Roads: All Unit Owners and occupants of any ~UT1c~f3ifiZT[1~iuu ~Iil~~ i~'i~~~ ~ilez'u~S esriti iiaYl`cco otioii ~:~1'~ ~:! easement over any private roads constructed on the Condominium Property. (7) Mortgages: In the event any easements, herein referred to,are encwnbered by a lien, other than those on the Condominium Parcels, such liens shall be required to be sub- ordinate or made subordinate to the use-rights of any Condominium Unit Owner or Owners whose Condominium Parcel is not also encumbered by said lien. In the alternative, an appropriate~ nondisturbance agreement may be executed and recorded providing at least in part that the use-rights shall not be termir-ated with respect to any Unit Owner or Owners whose Units have not been foreclosed for default. 4.04 Unit Boundaries: The Upper Boundary and Lower Boundary of eac Unit s a e the following, extended to the Perimeter Boundaries: (1) U__~ ~er Boundar : Up to and including the horizontal plan of the bac -c~su ace o tlie drywall which serv es as the Unit's ceiling (back-surface is herein used to indicate the surface of the.drywall farthest away from the space it is enclosing). (2) Lower Boundar : Down to and including the horizontal plane o- t e acc-surface of the structual slab which serves as such Unit's floor if such Unit is on the ground floor; down to and including the horizontal plan of the back-surface of the concrete topping which serves as such Unit's floor if such iTnit is on an upper floor . (3) Perimeter Boundar : The Perimeter Boundary of each Unit shall be up to an inc u ing the vertical plan of the back- surface of the drywall serving as a perimeter wall which plan shall be extended to each level's Upper Botmdary and Lower Boundary. Where a balcony or patio is attached to the Unit being bounded, the Owner of such Unit shall own the interior decora- tive surface of the floor and side of such balcony or patio. The Units shall also include all peri~eCer windows, screens, and doors. The Units shall not include entrance stairways, entrance walls, entrance balconies or common storage facilities in front of or at the end of buidlings.
