Condominium Parcels, Appurtenances, Possession and Enjoyment 6.01 The Condominium Parcel is a separate parcel of real property, owned in fee simple, or any other estate of real property recog~Lzed by law. thereto: (1) An undivided share in the common elements. 6.02 There shall pass with a Unit as appurtenances (2) The right to use such portion of the common elements as is provided for herein. (3) An Exclusive easement for the use of the air snace occupied by the Unit as it exists at any particular time and as the Unit may lawfully be altered or reconstructed from time to time, which easement shall be terminated automatically in any air space which is vacated from time to time. (4) An undivided share of the common surplus. 6.03 The OHmer of a Unit is entitled to the exclusive possession of his Unit. He shall be entitled to use the common elements in accordance-with the purpose for which they are intended but no such use shall hinder or encroach upon the lawful rights of the Owners of other Units. There shall be a joint use of the common elements and a joint mutual non-exclusive easement for that purpose is hereby created. 7. Restraint Upon Separation and Partition of Common Elements 7.01 The undivided share in the common elements which is appurtenant to a Unit shall not be separated therefrom and shall pass with the title to the Unit, whether or not separately descri~ed. 7.02 A share in the common elements appurtenant to a Unit cannot be conveyed or encumbered except together with the iJnit . 7.03 The shares in the common elements appurtenant to Units shall remain undivided, and no action for partitiion of the common elements shall lie. 8. Com~non ~lements 8.01 Coimnon elements include within their meaning the following items: (1) The land on which the improvements are located and any other land included in the Condominium Property, whether or not contiguous. gQO~ 350 Pa~E 221~. -~-
