(7) The power to own, convey and encumber real
and personal property.
(8) The powers to execute contracts, deeds,
mortgages, leases and other instruments.
(9) The power to purchase Units in the Condominium
and to acquire and hold, lease, mortgage and convey the same.
20.05 When the Board of Directors of the Association
is not controlled by the Developer, the Association shall have
the authority and power to maintain a class action and to
settle a cause of action on behalf of the Unit Owners with
reference to matters of common interest, including but not
limited to, the com~-on elements, the roof and structural
comnonents of a building or other impr~v~~n~ afld mechani~d~.
electrical and plumbing elements serving an improvement or
building, as distinquished from mechanical elements serving
only a Unit. In any case in which the Association has the
authority and the power to maintain a class action, the
Association may be joined in an action as representatives
of the same class with reference to litigations and disputes
involving the matters for which the Association could bring a
class action.
20.06 In any legal action in which the Association
may be exposed to liability in excess of insurance coverage
protecting it and the Unit Owners, the Association shall give
notice of the exposure within a reasonable time to all Unit
Owners who may be exposed to the liability and they shall have
the right to intervene and defend.
20.07 Service of process upon the Association r.iay be
had by serving any officer of the Association or by serving
the agent designated for the service of process. Service of
process upon the Association shall not constitute service of
process upon any t3nit Owner.
20.08 Nothing herein shall limit any statutory or
common law right of any individual Unit Owner or class of Unit
Owners to bring any action which may otherwise be available
in any Court.
20.09 A copy of each insurance policy obtained by the
Association shall be made available for inspection by Unit Owners
at reasonable times.
20.10 Failure to permit inspection of the Association's
accounting records by Unit Owners or their authorized represen-
tatives shall entitle any person prevailing in an action for
