(8) Fees for legal,.accounting and other professional services necessary or desirable for the operation of the comuan elements or the administration of the Condominium Association. (9) Fees payable by the Condominium Association to the Division of Florida Land Sale and Condominiums; (10) Any expense designated or contemplated as a common expense by the provisions of the Condominivm Act, this ~~~aratia:. ~f Candom~nium or tt~.~ By~aws; ~rd (11) Expenses agreed upon as common expenses by aIl Unit Owners. 22.02 Except as set forth hereinafter in this Article 22,the co~on expenses shall be shared by, and the common surplus shall.be owned by, each of the Unit Owners in pro- portion to each Unit Owner's undivided share in the co~on elements. The Board of Directors of the Condominium Association shall have the sole authority to determine whether or not the'common surplus shall be distributed to the Unit Owners. . 22.03 Except as otherwise set forth in Section 718. 116(8)(b) of the Condominium- Act of which Developer reserves the right, at its option, to avail itself in the manner provided by the Condominium Act~ no Unit Owner may avoid liability for assessments by waiver of the use or enjoyment of any common element or the abandonment of the Unit for which the assessments are made or for any other reason. 23. Assessments Liabilities Lien and Priorit Interest Co ections 23.01 The Association, through its Board of Directors, subject to the provisions of the Bylaws applicable thereto,shall have the power to fix and determine from titme to time the sums necesary to provide for the co~non expenses of the Condominium Property. The assessments shall include ha2ard and liability insurance premiums. A Unit Owner, regardless of how title is acquired, including without limitation, a purchaser at a judicial sale, shall be liable for all assessments coming due while he is the Owner of a Unit.
