Such right of indeumifica- tion shall not be deemed exclusive of any other rights to which such member of the Board of Directors and/or officer may be entitled as a matter of law or agreement or vote of Unit Owners or of the Board of Directors or otherwise. 29.03 Liabilities of Individual Unit Owners. The Unit Owners and any essees or su essees o a t all be jointly and severally liable for liabilities arising out of their own conduct or arising out of the ownership~ occupancy~ use, misue or condition of such Unit. 29.04 Lan ua e Concernin Liabilit• in A reements. Every agreement, contract, ee , ease, mortgage, or ot er written instrument or documents, or other transaction entered into by the Condominium Association shall provide, if reasonably obtainable, that the officers executing the same• are acting only as agents for the Unit Owners and shall have no personal liability thereunder (except to the extent~ if any, that they may also be Unit Owners at the time any such liability is assessed), that any claim by the other party or parties thereto in respect thereto or to the subject matter thereof shall be asserted against the Condominium Association, which shall act on behalf of the Unit Owners in respect thereto, that any liability thereunder or in repsect of the subject matter thereof shall be borne by those who are Unit Owners at the time such liability is assessed by Condominium Association as a co~nnon expense, for which assessment each such Unit Owner shall be liable only severally to the extent of his pro- portionate interest in the Condominium Property as herein provided. 29.05 Notice of Suit and 0 ortunit to Defend. Complaints brought against t e on omin u~ ssociation or the Board of Directors, officers, employees or agents thereof, in their respective capacities as such, or ttie Condominium Property as a whole, shall be directed to the Board of Directors, which shall give written notice thereof in the case of complaints containing major allegations, to the Unit Owners and first mortgagees, and shall be defended by the Condominium Association. Complaints of a nature specified in Article 29.03 hereof against one or more but less than all Unit Owners or Units shall be defended by such Unit Owners shall shall promptly give written notice thereof to the Condominium Association and to the first mortgagees holding mortgages on such Units. 30.
