WITNESSETH:
That Grantor, for and in consideratlon of the sum of TEN (t10.00)
DOLLARS and other good and valuable consideration paid by Grantee, the
receipt of which is hereby acknowledged, has granted, bargained, and sold to
Grantee and Grantee's heirs and assigns forever, the followinq described real
property situated, lying and being in St. Lucie County, F'lorida, to-wit:
The Condoatinium Parcel known as Apartment 939-A of
Phase Iv of HIGH POINT OF FORT PIERCE CONDOMINIi1M
SECTION III (the "Condominium" ) according to the Declar-
ation of Condominium thereof ("Declaration") , recorded in
Official Records Book 3~~ at Pages 2403 through2
of the Public Records ~ St. Lucie County, Florida as t e
Declaration may have been amended by any amendments
recorded in the Public Records of St. Lucie County,
Florida including, but not limited to, any amendment to
add the aforesaid Phase to the Condominium (if such
Phase be other than Phase I thereof).
Grantee, by acceptance hereof, and by agreement with Grantor hereby
expressly assumes and agrees to be bound by and to comply with all of the
covenants, terms, conditions and provisions set forth and contained in the
aforedescribed Declaration of Condominium, including , but not limited to, the
obligation to make payment of assessments for the maintenance and operation
of the Condatinium which may be levied against the above-described Apart-
ment. Grantee expressly acknowledges the existence of a Settlement Stipula- ?j
tion and Agreement for and Grant of Easements and Other Rights• (the "Settle-
ment Stipulatton") and a Declaration of Protective Covenants and Restricttons
(the "Protecdve Covenants" ), as well as the "Designation Notice" modifying
the Settlement Stipulation and Protective Covenants, all as hereinafter set
forth. The Settlement Stipulation provides for this Condominium to be served
by certain faciUties of High Point of Fort Pierce Condominium Section 1 and
the Protective Covenants provides for certain land use covenants upon the
land areas described therein (including, but not limited to, portions of the
land areas included within this Condominium) and provides for certain drainage
'.asements and other easements and rights including , but not limited to, the
"Roadway Easement", "Sewaqe System Rights", "Water System Rights" and
"Future Development Property Drainage Easement" , all as are more particular-
ly described therein, alI in addition to the other matters set forth in the
Settlement Stipulation and Protective Covenants, which other matters include,
but are not limited to, the obligation to pay certain "Assessments" as are
respectively _ set forth in the Settlement Stipulation and Protective Covenants .
Grantee expressly acknowledges and assumes the obligation to pay the amounts
assessed against the Apartment under both the Settlement Stipulation and
Protective Covenants and acknowledges that "Assessments" under both the
Settlement Stipulation and Protecdve Covenants aqainst all properties now or
hereafter included within this Condominium in accordance with the above-
described DecIaration of Condominium are "Common Expenses" of this Condomin-
ium as provided for in the Declaration of Condominium.
