COMl:S i10W the Petitioner, HELEN HARDACRE, Personal
Representative of the above estate, by and through.her undersigned
attorney, and hereby files her Motion to Set Aside the Order~of
Sumnnary Administration entered inthe above cause on November 25,
1980. As grounds therefor, Petitioner states:
1. On November 25, 1980, an Order of SuAmmary
~Administration was entered in this cause pursuant to the
~Petitioner's Petition for Summary Adrsinistration in accordance
~with the applicable Florida Statute_
2. The Petitioner herein was notified by Abstract and
Title Corporation of Florida, the title cor~pany which is handling
the sale of certain real property in this estate, that in order
to have title insurance written for the sale of the property,
formal adrninistration would have to be instituted in this estate
instead of si.unmary administration.
3. Since there are already buyers for the subject
~real property, it would be more expedient for the estate and
less costly to the estate to comply with the title company's
request by instituting forcial administration.
WHEREFORE, it is hereby requested that this Court set
