THIS INDENTURE, made this llth day of Februar , 198 1, between

WITNESSETN:
That Grantor, for and in consideration of the sum of . TEN (t10.00)
DOLLARS and other good and valuable consideration paid by Grantee, the
receipt of which is hereby acknowledged, has granted, bargained, and sold to
Grantee and Grantee's heirs and assigns forever, the following described real
property situated, lying and being in St. Lucie County, Florida, to-wit:
The Condominium Parcel known as Apartment 937A of
Phase IV of HIGH POINT OF FORT PIERCE CONDOMINIUM
SECTION IIl (the "Condominium" ) according to the Declar-
ation of Condominium thereof ("Declaration"), recorded in
Official Records Baok 3~ at Pages 2403 through254?_
of the Public Records o St. Lucie County, Florida as the
Declaration may have been amended by any amendments
recorded in the Public Records of St. Lucie County,
Florida including, but not timited to, any amendment to
add the aforesaid Phase to the Condominium (if such
Phase be other than Phase I thereof).
~ Grantee, by acceptance hereof, and by agreement with Grantor hereby
expressly assumes and agrees to be bound by and to comply with all of the
covenants, terms, conditions and provisions set forth and contained in the
aforedescribed Declaration of Condominium, including, but not limited to, the
obligation to make payment of assessments for the maintenance and operation
n of the Condominium which may be levied against the above-described Apart-
~ ment. Grantee expressly acknowledges the existence of a Settlement Sttpula-
tion and Agreement for and Grant of Easements and Othe: Rights- (the "Settle-
ment Stipulation") and a Declaration of Protective Covenants and Restrictions
(the "Protecdve Covenants") , as well as the "Designation Notice" modifying
o the Settlement Stipulation and Protective Covenants, all as hereinafter set
~ forth. The Settlement Stipulation provides for this Condominium to be served
by certain facilities of High Point of Port Pierce Condominium Section 1 and
the Protective Covenants provides for certain land use covenants upon the
_ land areas described therein (including, but not limited to, portions of the
land areas included within this Condominium) and provides for certain drainage
P.asements and other easements and rights including, but not limited to, the
"Roadway Easement" ,"Sewage System Rights" ,"Water System Rights" and
"Puture Development Property Drainage Easement" , all as are more particular-
~ ly described therein, all in addition to the other matters set forth in~ the
!~ Settlement Stipulation and P~otective Covenants, which other matters include,
~~ but are not limited to, the obliqation to pay certain "Assessments" as are
respectively set forth in the Settlement Stipulation and Protective Covenants .
Grantee expressly acknowledges and assumes the obligation to pay the amounts
assessed against the Apartment under both the Settlement Stipulation and
a Protective Covenants and acknowledges that "Assessments" under both the
!~ Setdement Stipulation and Protective Covenants agaidst all properties now or
~ hereafter included within this Condominium in accordance with the above-
described Declaration of Condominium are "Common Expenses" of this Condomin-
;~ ium as provided for in the Declaration of Condominium.
