which Mortgage was recorded on February 21, 1973 in the Public
Records of St. Lucie County, Florida at O.R. Book 211, Page
587; and
WHEREAS, the parties desire to make certain modifications
and changes in the payment of said promissory note and in the
mortgage securing the payment of said note;
NOW, THEREFORE, it is hereby agreed by and between
the parties hereto that the promissory note from Mortgagor
to Mortgagee, secured by mortgage dated February 19, 1973
and recorded in O.R. Book 211, Page 587 of the Public Records
of St. Lucie County, Florida, is modified as follows:
(1) Where said promissory note provides "the 60th
payment shall be $117,763.94 plus interest due on the 60th
month at the end of the 5th year.", the same is hereby amended
to read: "Thereafter, commencing on the lst day of June, 1978,
the sum of $1,491.55, and a like sum on the corresponding day
of each like succeeding period thereafter for 59 months together
with a final payment of $71,853.31 on May 1, 1983, plus interest
due on said final payment."
(2) It is further agreed that said note shall further
provide that on and after the lst day of May, 1978, it shall
bear interest at the rate of nine percent (9$) per annum on
the unpaid balance until maturity, and after maturity both
principal and accrued interest shall bear interest at nine ~
percent (9$) per annum until paid, ~~' than 7 1/2$ as provided in ~
original note. ~
