THIS CAUSE coming on for hearing this 16th day of March,
1981, upon the Motion to Dism3ss and Motion to Strike filed
by the Defendants, CITY OF FORT PIERCE and RONALD PARKER,
and the Court having heard argument of counsel and being
otherwise fully advised in the premises, it is upon consideration
ORDERED AND ADJUDGED as follows:
(1) That the Motion to Dismiss be and the same is
hereby denied.
(2) That the Motion to Strike be and the same is hereby
granted, and the allegations pertaining to paragraph (5) of
said Complaint as set out in paragraph (1) of the Motion to
Strike, to-wit: "...exonerating the Plaintiff, WAY*7~ MICHAEL
PRICE, of any F:rongdoing", and the allegations in Count I,
paragraph (9C) which state: "...after he was exonerated by the
grand jury of wrangdoing", and the allegations listing
MARY PRICE as a.party-plaintiff, be and the same are h~reby
stricken from said Complaint and tne Plaintiff shall ha~-e
twenty days from the date of this Order to file an Amended
Complaint.
