for sanctions, to Strike affirmative Defenses, and to
Dismiss the Counterclaiws of the Defendants, and Defendant's
Motion for Leave to File a Caunterclaim if discovery warrants
the same', and the Court, having considered the same, hearing
the arguments oi counsel, and being otherwise fully advised

claim if warranted by discovery is denied, without prejudice
to the Defendant hereaYter moving for leave to amend in the
appropriate manner.
2. The Motion to Strike the Affirmative Defenses is

3. The Motion to Strike Affirmative Defenses is
denied as to the Affirmative Defenses :aised in paragraphs
1, 2 and 3 of the Affir~ative Defenses.
