AGEEMENT
THIS AGREEMENT executed this ~day of 9ecer.iber,
1976, by and between GORHAM CONSTRL;CTION COMPANY, a Florida
corporation herein cailed first party and DIXIE ASPHALT
COMPANY, a Florida corporation herein called second party.
WITNESSETH: ~
WHEREAS, first part}~ has sold to second party this
date a certain parcel of real estate
Florida, more particularly described
hereto and as a part of said sale ;~
party an easement over the West 100
parcel of land described in schedule
has reserved unto itself an easement
of the property sold to second party
in St. Lucie County,
in exhibit A attached
~s granted to second
feet of that certain
B, attached hereto; and
over the West 140 feet
descriued in schedule A.
i~JHEREAS, the parties wish to agree to certain conditions
under which the above-described easements shall be used by
them,
tti'HEREAS, first party has warranted that the property
described in schedule A is zoned M-3 and the parties wish to
assure that the second party shall be allowed to erect and
operate an asphalt plant within a specified period of time;
and
l~7HEREAS, the parties wish to restrict the erection and
operation of only one asphalt plant on the real estate
described i*~ schedules A and B.
NOW, TtiEREFORE, in consideration of t~~e sale and purchase
described above, anci other valuable considerations, receip~
whereof is acknokledged by each party fror~ the other, first
and second parties agree as follows:
