THIS CAUSE was heard by this Court in a nre-trial hearing.
Present were counsel for the Defendant, LOUIS STINSON~ JP..~
as Trustee; the Attorney for the State of Florida, Division of
Administration, Department of Transportation,was not present.
The Court having conferred with said attorney and being otherwise -
duly advised upon the premises~ does ~
ORDER AND ADJUDGE as follows:
1. The date of valuation for purposes at the trial, of
parcels 102 and 701, shall be Decer.iber 12, 1979.
2. View will be taken at the close of t~stimony and before
argument of counsel, unless otherwise mutuall_y agreed. Petitioner
shall cause to have the area taken as to each parcel appronriately
marked and outlined.
3. The requested instructions nresented to the Court at the~
pre-trial hearing by the Defendant will be given. Further
requested instructions may be presented to the Court and given ~
if made necessary by unforeseen developments at the trial. ~
4. Attorneys' fees and costs will te detern;ined and entered
by the Court in a supplemental proceeding following the trial.
5. Petitioner's right-of-way map and constructi.on plans
wil~ be made available by Petitioner, and may be used in evidence
by anq party, if relevant. Petitioner will call a qualified
engineer to testify as to construction details.
