such connections the parties agree as followsi
(a) All consumer installation connections must be
inspected by Utility before backfilling and covering of any pipes;
ib) Nctice to Utility requesting an inspection of a
consuaner installatit~n connection may be given by the Plumber or
Developer and the inspection will be made with twenty-four (24)
hoursf
(c) If the Developer does not comply with the foregoing
inspection,provisions. Utility may refuse service to a connection
that has not been inspected until Developer complies with these
provisions. _
The parties hereto further agree that the cost~ or
expense of constructing all consumer installations and all costs
nnd expenses of operatinq, repairing and maintaining any consumer
installation shall be that of Deveioper or others than Utility.
14. This Agr~ement shall be binding upon and shall inure to
the benefit of Developer, Utility and their respective successors
and assigns. However, in the event Developer has not paid and
delivered to Utility the contributions in sid-of-construction
provided to be paid Utility by Developer under the terms of this
Agreement, then this Agreement shall not be sold, conveyed, assigned,
transferred or otherwise disposed of by Developer. without the .
written consent of Utility first having been obtained. bowever,
Utility agrees not to unreasonably withhold such consent. This
Agreement sha~l also be binding upon all successors in interest of~
either party by operation of law.
Utility is hereby granted the zight to assign this Agreement
and this Agreement shall survive the merger, sale, incorporation, or
acquisition of the System or Utility.
15. Until further written natice by either party to the other, ~
all notices provided for herein shall be in writing and shall be
mailed or delivered to Developer at:

16. The rights, privileges, obligations and covenants of
Developer and Utility shall survive the completion of the work
cf Utility with respect to completing the sewer facilities and
service to any stage area nnd to the Property as a whole.
