Developer agrees to pay to the Utility certain cha~ges ~elative to plant .
capacity. Utility ag~ees that the charges to be charged to Developec shall be those
set forth in the ta~iff of the Utility as amended f~om time to time and approved by
the applicable governmental a~,ency, or as mandated by law. Those charges shall
be:
(a) Plant _ Capacity Charges: Utility has advised Developer that
Develope~ will be obligated to pay Utility certain amwnts per each Equivalent
Residential Connection (ERC) as a contribution t:: plant capacity. Th~ uniform
charge of the Utility at the execution of this Agreement is $37S for each
Equivalent Residential Connection, as mandated by the Florida Public Service ~
Commission. Said amount of $375.00 per ERC shall be due and paid by Developer .

ratably as Developer requests meter installation for each such ERC. For purposes •
of this Agreement an ERC shall be eo,ual to 3S0 gallons per connection per day.
(b) Guaranteed Revenues: 8y virtue of the provisions of this Agreement,
the Utility has reserved for Developer 200 equivalent single-family residential units
of water and sewer treatment capacity. The Utility has advised Developer that it .
requires minimum levels of guaranteed revenue in order to support investment in
plant facilities as well as the fixed cost of maintaining s~ch facilities and the
unused capacity it represents. Therefore, Developer ag~ees to pay, upon the
execution of tl~is Agreement, one year's guaranteed revenue in advance of the said
200 ERC units, which amounts to the sum of $16,800.00. At the end o: u^~ year
. after the date of making said payment, Developer shall be entitled to a refund of a
portion of such advance annual payment, equal to the number of ERC units actually
connecte~+ during said 12 month period times the number of actual whole months
that each consumers occupying a family cesidentiat unit shall have paid actual
revenues to the Utility, times the monthly minimum charges used as the basis for
the original ad~ance guaranteed revenue payment. For purposes of this formula,
each connection shall be analyzed separa~ely to determine the number of months
actually connected and the refund potential. ,
For purposes of this Agreement term "ERC" shall always be deemed
350 gallons of tr~atment capacity per day.
At the conclusion of the first year, all ERC units not connected out
of the cumulative totai agreed to be connected shall be established as the number
of ERC units to be the subject of a iurther guaranteed revenue advance for the ~
next succeeding 12-month period, and in like manner, said annual guaranteed
~evenue advance shall continue from year to year until such time as all ERC units
agreed to be constructed have in fact been constructed and connected to the
system.
The amounts to be paid will be based on the minimum service cha~ge
1or such ERC as published in Utility's tariif and approved by the governmental
~egulatory age~cy having jurisdiction over the Utility's rates. The requirement tor
the payment of said guaranteed ~evenues shall be binding upon Developer, its
successors and assigns or subsequent owners holding by or through Developer.
