facilities and to contihuously provide consumers located on the
Property with water services, Developer hereby covenants and
agrees to construct and to transfer ownership and control to
Utility as a contribution in aid-of-construction the on-site
water distribution system referred to herein as a contribution
in aid-of-construction.
Developer shall cause to be prepared engineering plans
prepared by and sealed by a professional engineer registered in
the State of Florida, showing the on-site water distribution sys-
tem proposed to be installed to provide service to consumers with-
in the subject Property. Such detailed plans may be limited to
the first Stage area only and subsequent stages may be furnished
from time to time. However, each such Stage area shall conform
substantially to a master plan for the development of the Property
and such master plan shall be submitted to Utility concurrent with
or prior to submission of engineering for the first Stage. Deve-
loper~shall cause his engineer to submit specifications governing
the material to be used and the method and manner of installation.
All such plans and specifications submitted to Utility's engineer
shall be subject to the approval of Utility and no construction
shall commence until Utility has approved such plans and specifi-
cations ir. writing. Complete as-buiZt plans shall be submitted
to Utility upon completion of construction. After the approval
of plans and specifications, Developer shall cause to be construc-
ted, at Developer's own cost and expense, the water distribution
system as shown on the plans and specifications.
Developer shall be required to pay the applicable charge
(as set by Utility from time to time) for water meters and meter
installations of sufficient capacity for all single family resi-
den~ial, multi-family, mobile home, commercial installations and
meter installations of sufficient capacity for all single family
residential, multi-family, mobile home, commercial installation
or any other connection requiring a measuring device.
During the construction of the water distribution system
by Developer, Utility shall have the right to inspect such in-
stallation to determine conformation with tne plans and specifi-.
catior.s as submitted by the Developer to Utility subiect to agreed
upon changes. Utility shall control the quality of the installa-
tion and further shall be_entitled to perform standard tests for
infiltration, exfiltration, line and grade all other normal engi-
neering tests tu determine that the. system has been installed in
accordance with the plans and specifications ar.d good engineering
practices. Developer agrees to pay to Utility or Utility's auth-
orized agent, a reasonable inspection fee in an amount equal to
1$ of the contract price if the Developer's installations will add
more than 100 ERC's ~o the water distribution system. If the num-
ber of ERC's to be added to the water distribution system is a
hundred ERC's or less, then the amount to be paid as a reasonable
inspection fee will be equal to 2$ of the contract price. Such
inspection fee shall be payable upon construction of each phase
or Stage of development.
Provided that Utility shall be ready, will~.ng and able
to render service to Developer, by these presents, Develoger
hereby transfers to Utility, title to all water distribution
systems installed by Deve~oper or Developer's contracter, pur-
suant to the provisions of this Agreement, such conveyance to
take effect without further action upon the acceptance by Utility
of the said installation. As further evidence of said transfer
of title, and upon the completion of the installation and prior
to the rendering of service by Utility, Deve~~per sha~l convey to
Utility, by Bill of Sale, in form satisfactory to Utility's
