representations, either verbal or written, heretofore in effect
between Developer and Utility, made with respect to the matters
herein contained, and when duly executed, constitutes'the Agree-
ment between Developer and Utility. No additions, alterations,
or variations of the terms of this Agreement shall be valid, nor
can provisions of this Agreement be waived by either party unless
such additions, alterations, variations, or waivers are expressed
in writinq and duly siqned.
17• This Agreement shall be governed by the laws of the
jurisdiction in which the Property is located and it shall be and
become effective immediately upon execution by both parties hereto.
18. In the event the Utility is required to enforce this
Agreement by court proceedings or by proceeding before the Florida
Public Service Commission or any other regulatory agency or other-
wise, by instituting suit or otherwise, then the Utility shall be
entitled to recover all c~sts incurred including reasonable attor-
ney's fees, includin~ reasonable attorney's fees incurred in the
event of an appeal.
19. Subject to the termination provisions of Paragraph 7 hereof
this Agreement shall be coupled with in interest and shall run with
the Property for the benefit of subsequent,owners of the Property.
The Utility shall not be obligated to perform its obligation he~e-
under, however unless said subsequent owners fuYfills the obligation
of the Developer hereunder, but nothing herein shall obligate a
subsequent owner from having to so fulfill Develooers obli.c~~ta~~_
