HomeMy WebLinkAbout1565Developer and the inspection will be made within twenty-four (24) hours; (c) If the Developer does not comply with the foregoing inspection provisions, Utility may refuse service to a connection that has not been inspected until Developer complies with these provisions. The parties hereto further agree that the costs or expense of constructinq all consumer installations and all costs and ex- penses of operating, repairing and maintaining any consumer instal- lation shall'be that of Developer or others than Utility. 13. Thie Agreement shall be binding upon and shall inure to the benefit of Developer, Utility and their respective successor and assiqns. However, in the event Developer has not paid and delivered to Utility the contributions in aid-of-construction pro- vided to be paid Utility by Develoger under the terms of this Agreement, then this Aqreement shall not be sold, conveyed, assigned, transferred or otherwise disposed of by Developer without the written consent of Utility first having been obtained. However, Utility agrees not to unreasonably withhold such consent. This Agreement shall also be binding upon all successors in interest of either party by operation of law. Utility is hereby granted the right to assign this Agreement and this Agreement shall,survive merger, sale, incor- poration or acquisition of the system or Utility. 14. Until further written notice by either party to the other, all notices provided for herein shall be in writing and mailed or delivered by mail to Developer at: The Sands Ocean View Development • 3201 ~orth AIA Ft. Pierce, Florida 33450 with copy to: Myers, Kaplan, Levinson, Kenin ~ Richards Suite 103, 1020 East Lafayette Strezt Tallahassee, Florida 32301 15.
